These Terms of Service ("Terms") govern your access to and use of the Mortovia website, products, services, digital content, and related platforms (collectively, the "Services"). By accessing the website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated herein by reference. If you do not agree, you may not access or use the Services.

ACCEPTANCE OF TERMS

Mortovia operates as a premium print-on-demand and limited-release apparel brand. These Terms apply to all users of the Services, including browsers, customers, vendors, merchants, and contributors of content.

By accessing the Services, you represent and warrant that:

• You are at least the age of majority in your jurisdiction of residence;

• You have the legal capacity to enter into binding agreements; and

• You will not use the Services for any unlawful or unauthorized purpose.

PERMITTED USE & PROHIBITED CONDUCT

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

• Violate any applicable law or regulation;

• Infringe any intellectual property, privacy, or proprietary right of any party;

• Transmit malicious code, malware, or other harmful technologies;

• Attempt unauthorized access to the Services or related systems, databases, or accounts;

• Engage in fraud, abuse, harassment, or deceptive practices;

• Scrape, data-mine, crawl, or automate the extraction of website content;

• Distribute spam, phishing communications, or otherwise deceptive content; or

• Interfere with platform functionality, security, or network operations.

A breach of this Section may result in immediate suspension or termination of access to the Services without notice.

ACCOUNT INFORMATION & ORDER ACCURACY

You agree to provide current, complete, and accurate information for all accounts and transactions. You are solely responsible for maintaining the accuracy of your:

• Email address;

• Billing and payment details;

• Shipping address; and

• Any other account information.

Mortovia reserves the right to refuse, limit, cancel, or restrict any order that appears fraudulent, unauthorized, or potentially in violation of these Terms. Where practicable, Mortovia will attempt to notify you using the contact information provided at checkout.

PRODUCTS, PRICING & SERVICE MODIFICATIONS

Mortovia products are produced on a made-to-order and limited-release basis. Mortovia reserves the right at any time, without prior notice, to:

• Modify, suspend, or discontinue any product or feature;

• Adjust pricing;

• Correct pricing errors, typographical errors, or inventory inaccuracies; and

• Limit product quantities or restrict regional availability.

Product images and color representations are provided for illustrative purposes only. Mortovia does not warrant exact color accuracy across all screens or devices, nor does it warrant that product descriptions, images, or other content are entirely error-free, complete, or current at all times.

SHIPPING, RETURNS & REFUNDS

Fulfillment timelines are estimates only and may be affected by production volume, carrier delays, international customs processing, supply chain disruptions, or other events outside Mortovia's reasonable control. Shipping, returns, exchanges, and refund eligibility are governed by the separate Shipping & Returns Policy, which is incorporated herein by reference.

Because all products are produced to order, returns or exchanges based solely on buyer preference — including sizing selection or change of mind — are generally not accepted except where required by applicable law. Mortovia reserves the right to deny claims that: (i) fall outside stated claim windows; (ii) lack supporting documentation; or (iii) show evidence of misuse, excessive wear, or unauthorized alteration.

INTELLECTUAL PROPERTY

All content on the Mortovia website is owned by or licensed to Mortovia and is protected under applicable intellectual property laws. Protected materials include, without limitation: logos, brand marks, product names, graphics, apparel designs, images, video content, editorial copy, site layout, and visual systems.

You may not reproduce, copy, distribute, modify, sell, exploit, or otherwise use any Mortovia content for commercial purposes without prior written authorization. Unauthorized use may constitute infringement under applicable copyright, trademark, or other intellectual property law.

DISCLAIMER OF WARRANTIES

THE SERVICES, PRODUCTS, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORTOVIA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF CONTENT.

MORTOVIA DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE CONTINUOUSLY AVAILABLE OR UNINTERRUPTED; (B) THE SERVICES WILL BE FREE OF ERRORS OR SECURITY VULNERABILITIES; OR (C) THE PRODUCTS WILL MEET EVERY INDIVIDUAL CUSTOMER EXPECTATION.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MORTOVIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, PRODUCTS, OR CONTENT, EVEN IF MORTOVIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, MORTOVIA'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC ORDER OR PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities; accordingly, portions of Sections 7 and 8 may not apply to you.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Mortovia and its affiliates, officers, owners, employees, contractors, service providers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to: (i) your breach of these Terms; (ii) your misuse of the Services or products; (iii) your violation of any applicable law or third-party right; or (iv) your unauthorized use of Mortovia intellectual property.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the appropriate state or federal courts located in Florida, and you hereby irrevocably consent to personal jurisdiction and venue therein.

Before initiating formal legal proceedings, both parties agree to attempt good-faith informal resolution of any dispute.

SEVERABILITY & WAIVER

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. Mortovia's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

TERMINATION

These Terms remain in effect unless terminated. You may terminate at any time by discontinuing use of the Services. Mortovia reserves the right to suspend or terminate your access, without prior notice and at its sole discretion, if Mortovia reasonably believes you have violated these Terms or applicable law. Sections 6, 7, 8, 9, and 10 shall survive any termination.

THIRD-PARTY SERVICES & EXTERNAL LINKS

Mortovia may integrate or rely upon third-party services for ecommerce infrastructure, payment processing, shipping logistics, analytics, advertising, and marketing communications. Third-party services operate independently and are subject to their own terms and privacy policies. Mortovia is not responsible for the availability, accuracy, or practices of any third-party website or service.

PRIVACY

Your use of the Services is also governed by the Mortovia Privacy Policy, which is incorporated herein by reference. Please review the Privacy Policy to understand how personal information is collected, used, stored, and protected.

MODIFICATIONS TO THESE TERMS

Mortovia reserves the right to update, modify, or replace any portion of these Terms at any time. Changes become effective immediately upon posting to the website unless otherwise specified. Your continued use of the Services following any modification constitutes your acceptance of the revised Terms. You are encouraged to review this page periodically.
